Disclosure of Septic Systems on Property Ownership Transfers
The disclosure of any septic system on a property is a state law requirement per
Minnesota Statute §115.55, subd. 6 and
County Ordinance. The Blue Earth County Subsurface Sewage Treatment System Ordinance requires that at the point of property ownership transfer that either:
- A compliance inspection or current certificate of compliance be presented to the buyer, or
- A written agreement that the septic system will be replaced within 10 months of the transfer.
Note:
All methods require a copy to be submitted to the County.
In the case of a winter sale, the seller and the buyer file a Transfer Agreement with Blue Earth County Property and Environmental Resources Department. This will allow a delay in the inspection, however one will still be required to be completed as soon as conditions allow and no later than June 1.
